Every timeshare contract must include information about your right to rescind, and instructions on how to do so. The state of California provides timeshare purchasers with 7 calendar days to rescind the purchase of a timeshare contract. Timeshare companies and their salespeople are very well aware of the right to cancel a timeshare purchase. For this reason, timeshare salespeople tend to use all kinds of unscrupulous practices to prevent you from rescinding. Their actions can be subtle like getting you into a sales presentation early in your vacation so by the time you get home the rescission period has passed. Passive like ignoring your calls and emails for information on how to rescind. Or active, by outright lying about how much time you have or your rights under the law. Additionally, timeshare salespeople are under no obligation to make sure that you are aware of your right to cancel your contract. In every timeshare contract there is a disclosure that informs you of exactly how long you have to cancel, but many timeshare companies will use tactics to obfuscate your rights to ensure you do not fully understand how long you have to rescind or cancel. The laws regarding rescission periods are not as well know as they should be. Every state, and most countries give consumers at least 5 days to cancel a timeshare contract. Some of the only countries that do not have rescission periods as a matter of law are Aruba, Costa Rica, and the Dominican Republic. Even Mexico has a five day period to review and cancel your contract.
